Every time someone jokes about someone getting raped in prison I always point out that it tends to be nonviolent offenders and innocent people that get raped and it's usually the person we're joking about that rapes them. Guard do a lot of the rape too, particularly male guards working in female prisons. It's fucked up that we allow this.

Our for-profit prison system is very good at turning nonviolent drug offenders into violent rapists. They fucking like that, it's repeat business for them.

It is easier to end up in prison in America than nearly any other place. We've so vilified "criminals" that we hold the same fucking contempt for innocent people that are wrongfully convicted. A SWAT team put a package full of drugs on a random homeowner's doorstep, waited for them to take it in then kicked their door down, shot their dogs, and then decided to let them go. The homeowner turned out to be the mayor of the town. You know what question the media asked?

"Why didn't you know it was the mayor's house?" Not "What would you have done if it hadn't been the mayor" or "Did you just admit to trying to frame a random homeowner for drug smuggling?"

I just can't even wrap my fucking head around this.

Yeah, and a serial rapist that got convicted of repeatedly raping a woman over a period of five years had to leave her permanently rendered incontinent before anyone did anything. He spent 60 days in jail, after which he got to return to the community without having to register as a sex offender. Oh, and he lost his cool prison job that apparently came with really good rape benefits.

Serial rapists that don't hatefuck their victims into the hospital are basically free to rape and return to their homes at night without fear of prosecution or even social sanction. People that don't think that's a terrible thing deserve to be fed their own genitals. That doesn't mean I have the right to do that to them.

Seeing as I live in a different part of the country, have never met the guy, have no connections with the justice system, have no way of personally intervening even if I knew the rape was going down, and was totally unaware of this poor rapist's plight until I happened to see it on a ten minute TV spot via poeTV, a year or more after all this drama actually went.

I wasn't referring to you, but yes, you're part of the state, aren't you? This is a democracy and you are a part of that. There's a lot of fucking separation between you and the actions of the government, but you aren't fucking innocent of the things the government does on your behalf.

There's plenty of men and women being raped in the prisons in your state, I'm sure. It's a lot like pedophilia in the 50s. It's illegal, but we're still okay with it as a culture so the laws don't get enforced. People that think it's okay are the only reason this still happens.

Blue - Actually, I sort of agree with you there. We are all, at least partially, responsible for what the state "does on our behalf". That's a big part of why I tend to be skeptical about letting the state do anything "on my behalf". I voted for Gary Johnson, but of course, he lost. Oh well. What more can I do? Armed revolution? Build my own utopia under the ocean? What do you do, to make yourself less guilty of second degree prison rape?

But really, calling the US prison "private" is both wrong and horribly misleading. The US prison industry is, like so much else in this country, a sort of Keynesian corporatist hybrid- not quite nationalized, not quite private. It consist largely of insulated, nonaccountable paragovernmental agencies who work through contracted bids handed down to them by the state. It's a closed market, created, maintained, and controlled by the state, legitimized through (and provided raw materials directly from) the state's legislatuve and judicial branches. It's "private", in the sense that at least part of the "manufacturing" side is operated by nonelected officials, but it's hardly a free market.

So how about this, just an idea. Why not open up the prison system? To the idea of "consumer choice"? Allow prisoners to choose which prison facilities to attend, within practical limits imposed by the severity of their sentence. Make the prison-industrial system compete for it's customers. You can keep the almost entirely tax funded payment system (no need to revert to a Victorian rich prison/ poor prison setup), just give prisoners the option to select what prison they want on an individual basis, rather than having it chosen for them by a single corrupt, bureaucratic entity. It would then be in the prison-industrial system's best interest to produce RESULTS - as measured by access to rehabilitation services, quality of life, rape prevention safeguards, and other things- rather than the current "optimal strategy" of simply producing repeat business at the cheapest possible cost.

Like in so many other areas of modern society, "profit" isn't what's wrong here, rather, it's HOW that profit is acquired. If you make the prison-industrial system's profits accountable to performance, rather than an entitlement delivered via corporate welfare, things should improve very quickly.

Anyways, I wasn't aware that Johnson was opposed to either porn or gay marriage. There's certainly a sizeable number of "libertarians" (i.e. conservative Republicans who suddenly realized they hate the government once Bush was ousted) who actively want to ban those things, but to my knowledge neither Johnson nor The Libertarian Politburo were willing to pander to that base (all of whom were going to vote for Romney, anyway) On the contrary, Johnson's been a pretty solid backer of gay marriage- even outqueering Obama (who was, as you'll recall, pretty leery around gay marriage even as far back as the heady days of his early progressive/socialist hype period, c 2005)

Do you have some sources on this? I admit, I may have missed the sudden implementation of "Libertarian Opposite Day", what with all the big media focus and public outrage over Jill Stein getting handcuffed to a goddamn chair for the crime of trying to participate in a presidential debate.

Spoonybard - how so? Money is money, whether it comes directly from the consumer, or from the state. It's not like prison just "happens" to people, for free; prisoners are always "paying" for their stay, that's what makes them such an attractive market segment for private corporations. All I'm suggesting is that prisoners be given an active role in choosing where their state-issued "rent" checks get sent.

In fact, I'd even go so far as to say we'd see LESS classist stratification in prisons. We've all heard the term "white collar prison", right? Nice, comfy, relatively easy prisons reserved for the "least objectionable" class of prisoners? The biggest difference between them and conventional prole prisons is in quality of life and access to services, which again, should improve across the board once we empower prisoners to start voting with their (government alloted) wallets.

I know you don't like libertarians, but I think you'd find that, so long as the subject steered clear of economics and the role of the state, you'd be mighty pleased with their social platform. They out prog the Dems, at least, and I'd argue that due to their core mistrust of state authority and non-mutual relationships, they're a more natural fit for championing social freedoms.

If the public is footing the bill, prisons should compete in terms of their net benefit to society, not on how attractive their facilities are to convicts. Less crowding and improved care may better serve the interests of rehabilitation, but what you propose merely prioritizes the prisoner's comfort, not his betterment.

True story: I watched this on natgeo and was, like many, captivated by this pathetic, quivering creature enough to look up him up on the internet. There is, somewhere on the WWW, a forum of people who no joke banded together and have campaigned over an extended period of time to actually make his life easier, because of what they saw of him on television. I found it more or less mind blowing that people would take the side of a felon they had never met and petition the state to set him free and generally regard him as a saintly ne'er do well who was merely the victim of circumstance. I cite the old adage "don't do the crime if you can't do the time" as a representation of my opinion on the issue, but no shit this is a shockingly frank example of how people like to let reality television influence their lives.

Many of those people are in there for a crime that literally the last four presidents are guilty of. Those are the people that bear the brunt of this abuse.
